How it works
Accreditation Process
Submit Application
Eligible ADR Service providers, Centres and Training institutes (public & private) can apply for Accreditation using specific application forms available on the webpage www.padra.com.pk on payment of prescribe fee.
Scrutiny and Grant of Certificate
PADRA on receipt a accreditation application will scrutinize, grant accreditation and issue accreditation certificate.
Rejection of Application
PADRA, after due process, may reject the application submitted by ADR service provider, ADR Centre and ADR training institute, for reason to be recorded in writing.
ADR Database
PADRA will prepare and maintain a database of ADR service providers, ADR centres & ADR training institutes and make such data publically accessible through its official website and share it with all relevant stakeholders.
How it works
ADR Referral Process
Who may undertake ADR
Parties directly, counsels of parties, mediator judge (to be nominated by Lahore High Court), ADR service provider and ADR Centres.
Reference to the Mediator Judge
The court may refer the case to mediator judge under the Act for ADR and its completion within the stipulated time.
Reference in Civil Disputes
The civil court can refer a case as mentioned in Schedule 1 & 2 to ADR service provider or ADR center as provided the Punjab ADR Act.
Reference in Criminal Disputes
The criminal court can refer a case falling under sub-section (1) of section 345 of the code of criminal Procedure, 1898 (V of 1898) to ADR service provider or ADR centre.
How it works
ADR Proceedings
Selection of ADR Service Provider or Centre
The parties to the case may, with their mutual consent, select the ADR service provider or ADR centre from the list provided to them by the concered court for ADR.
Costs & Fees
The costs & Fees for the process of ADR proceeding shall be born by the parties in such proportion as may be mutually agreed upon by them and in case of disagreement it shall be determined by the concered court.
Power to Refer a case for ADR at any time
The court may, with the consent of the parties to the case pending before the commencement of the Act, refer such case to the ADR service provider or ADR centre for ADR under the Act.
Judgement and decree
When the outcome of the ADR is returned to the court and the court finds that the matter has been completely or partially resolved in accordance with applicable law, the court shall pronounce judgment and in case of a civil dispute pass a decree in terms of the agreed settlement.
